TERMS AND CONDITIONS OF THE “BUY Fuxion” ONLINE STORE

Access to and use of the internet shopping service via the “BUY Fuxion” from Fuxion Biotech S.A.C. (hereinafter, “Fuxion”) online store is subject to Peruvian law and it is addressed exclusively to clients in Peru. Users are subject to the Fuxion General Terms and Conditions, along with all other policies and principles applicable to Fuxion, which are incorporated hereinto by reference. The contractual relationship between users (hereinafter, the "Users") and Fuxion is governed by the following terms and conditions:

Fuxion’s online store is an internet-based technological tool that provides a digital channel for purchases and sales between Fuxion as SELLER, and persons who are not registered as "Fuxion Entrepreneurs" or as "Customers" in the Fuxion database, who individually constitute THE BUYER or THE USER.

THE USER REPRESENTS TO HAVE READ AND UNDERSTOOD ALL THE CONDITIONS ESTABLISHED IN THE PRIVACY POLICIES AND THESE TERMS AND CONDITIONS AND DECLARES CONFORMITY AND ACCEPTANCE AT THE TIME OF REGISTRATION AND/OR USE OF THE “BUY Fuxion” ONLINE STORE. ANY INDIVIDUAL WHO DOES NOT ACCEPT OR AGREE WITH THESE MANDATORY AND BINDING TERMS AND CONDITIONS SHALL REFRAIN FROM USING THE “BUY Fuxion” ONLINE STORE.

Access to the site is free, except for the cost of connection via the telecommunications network provided by the service provider (ISP) to which the User has subscribed, which shall be at his/her exclusive expense. The User may only access the site through authorized means.

It is not necessary to register as a User to access the contents of the “BUY Fuxion” ONLINE STORE. To complete the purchase, THE BUYER is required to enter his/her full name, identity document number, e-mail address, contact phone number, and the shipping address where he/she wish to receive the purchase.

Fuxion may use various means to identify Users, but is not responsible for the accuracy of the Personal Information provided by users or buyers. Each USER or BUYER guarantees and assumes responsibility, in all cases, for the truthfulness, accuracy, validity, and authenticity of the Personal Information provided to Fuxion.

The Personal Information provided by the User must be accurate, current, and truthful at all times. Fuxion reserves the right to request any additional proof and/or information to corroborate the Personal Information, and to temporarily and/or permanently suspend any Registered User whose information cannot be confirmed. Fuxion is NOT responsible for the accuracy of the information entered.

Our website has been developed to guarantee the confidentiality of the information provided by our customers.

The purchase of products offered on the site may be paid using the available means of payment: online payment (Pay U), internet banking, or cash payment (SafetyPay). Payment processing will be subject to the terms and conditions and privacy policies of each Payment Processor.

Card issuing bank. If the bank does not approve the transaction after it is made or we do not receive confirmation even if the transaction is successful, Fuxion may cancel the purchase and refund the amount to the credit or debit card. Likewise, Fuxion may verify the information of the person who performed the transaction through the “BUY Fuxion” online store with a phone call (to the registered phone number), for security reasons or in case of suspected fraud. Only after the relevant information has been confirmed will the sale be approved. Otherwise, the transaction will not go through, and the amount of the purchase will be refunded to the holder’s debit or credit card.

NOTICE: Fuxion will not reserve or hold products until they are paid for

In the event that you pay for a product that is out of stock, you will be notified and the cost of the product will be refunded.

In the case of payments using SafetyPay or cash payments, after choosing this option, make sure to keep the transaction number and the amount payable. Then, enter the website of the financial institution through which you will be making the payment. Enter your card number and PIN, select the “Service Payment” option and look for the “SafetyPay” or “Cash Payment” option. Type in the transaction number and the amount payable. A purchase confirmation will then be sent to you.

Payments made by credit card are subject to the evaluation and verification of the information provided.

The applicable rates for the Delivery Service will be set by Fuxion based on the geographical location and the demand for deliveries at the destination. Delivery fees will be included in the total amount payable, including value added tax (VAT). The fees charged for the Delivery Service are non-refundable.

The order recipient must have a telephone number via which to coordinate the delivery (time, place, person who will receive the order, recipient’s identification, etc.).

Regardless of the method of payment, the person in charge of the delivery may request an ID or resident alien card as identification of the order recipient, as well as a signature on the delivery waybill. Orders will not be delivered to minors.

The “BUY Fuxion” online store is solely responsible for the quality of the products, as well as the quality of the shipment.

Delivery options are indicated in local time in Lima, Peru.

If the time selected falls outside of the established schedule, our Service Advisor will contact the recipient to inform about the service availability and coordinate the delivery of the order.

Exchange and Return Policy for purchases made in the “BUY Fuxion” online store.

If, for any reason, you are not satisfied with your purchase from the “BUY Fuxion” online store, you can exchange or return your purchase in its original condition within the first thirty (30) business days after the purchase was made.

Fuxion is not responsible if the User does not have a smart phone compatible with use of the site. The Registered User agrees to make proper and lawful use of the Application in accordance with the applicable laws, these Terms and Conditions, generally accepted morals and decency, and public order. By using the site, the User agrees that:

• He/she will not attempt to cause harm to the site in any way, nor access restricted resources on the site.
• He/she will not use the site through an incompatible or unauthorized device.
• He/she will not try to access, use, and/or manipulate the information of Fuxion and other Users.
• He/she will not introduce or spread computer viruses or any other physical or logical systems that are likely to cause harm to the site.

Fuxion does not guarantee the availability and continuous functioning of the site. Consequently, Fuxion shall not be responsible in any way for any damages and/or harm that may arise from: (i) the lack of availability of or access to the site; (ii) interruption in the site’s functioning or information technology failures, telephone malfunctions, disconnections, delays, or blockages caused by deficient or overloaded telephone lines, data centers, internet systems, or other electronic systems that may arise in the course of its functioning; and, (iii) other damages that may be caused by third parties through unauthorized interference beyond the control of Fuxion.

Fuxion does not guarantee the absence of viruses or other elements in the Application introduced by third parties unrelate to Fuxion that may cause alterations in the Registered User’s physical or logical systems or in the electronic documents and files stored in their systems. Consequently, Fuxion shall not be responsible in any event for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations to the User’s physical or logical systems, electronic documents or files.

Fuxion uses various protective measures to protect the Application and its contents against third-party computer attacks. However, Fuxion does not guarantee that unauthorized third parties (using illegal or fraudulent means) cannot gain access to the conditions, characteristics, and circumstances under which the Registered User accesses the Application. Consequently, Fuxion shall not be responsible in any way for any damages that may arise from said unauthorized access.

The User acknowledges and accepts that all intellectual and industrial property rights over the contents and/or any other elements included in the Application (including, but not limited to, brands, logos, trade names, commercial slogans, texts, images, graphics, designs, sounds, databases, software, flow charts, presentations, audio and video, and/or any other intellectual and industrial property rights of any kind), belong to and are the exclusive property of Fuxion.

Fuxion authorizes the User to utilize, view, print, download, and store the contents and/or elements on the site exclusively for their personal, private, and non-commercial use. The User shall refrain from carrying out any act of decompilation, reverse engineering, modification, disclosure, or supply. Any other use of any content and/or other elements included on the site except for those expressly provided for here shall be subject to prior authorization of Fuxion.

Under no circumstance shall access to the site and/or acceptance of the Terms and Conditions be understood to create any right of assignment in favor of the Users or any third party.

Fuxion is responsible for all content on the website, as well as for any changes that may be made to it.

The personal information provided by Users when making purchases on the site will be treated in accordance with the Law N° 29733 Personal Information Protection Act and its Regulations, approved by Supreme Decree (Decreto Supremo) 003-2013-JUS and related Standards. As such, Fuxion is obligated to strictly comply with the regulations, as well as to maintain the maximum standards of security, protection, safeguarding, storage, and confidentiality of the information received or sent.

The Users represent that their personal information has been delivered absolutely freely and voluntarily, without any type of pressure, obligations, or conditions.

The User represents and accepts that Fuxion may perform any appropriate notifications by text message or e-mail at the number or address provided by the User, including messages for promotional or advertising purposes. The Registered User may notify Fuxion and ask to be unsubscribed from promotional or advertising messages by submitting a request in the Support section available on the online platform.

The photographs of the products that appear on the site are for reference purposes only. There may be variations between the photo shown in the “Buy Fuxion” online store and the product received.

Any questions or complaints regarding this site shall be submitted through our Customer Service channels from Monday to Friday from 9:00 a.m. to 6:00 p.m. and Saturdays from 9:00 a.m. to 2:00 p.m. through WhatsApp chat at 986 867 611.

The prices of the products and services available on this site, for as long as they appear on it, will only be valid for and applicable to this site and will not necessarily be applicable to other sales channels used by Fuxion, unless Fuxion so states. Likewise, the company may modify any information contained on this site, including information on merchandise, services, prices, stock, and conditions, at any time and without prior notice, honoring all purchases that have been accepted up to that time.

The promotions offered on this website are not necessarily the same as those offered via other sales channels used by Fuxion, such as physical premises, unless expressly stated on this site or in the advertising of the supplier company for each promotion.

These Terms and Conditions, as well as the relationship between Fuxion BIOTECH S.A.C. and THE USER, shall be governed by and interpreted in accordance with current Peruvian law and the following documents:
